Do Good Labs may amend these Terms and Conditions from time to time. Any amendment will be effective immediately upon notice by email, conventional mail service, or any other means of communication, including notification in this section of this Website. Your continued use of this Website after any amendment becomes effective constitutes an agreement by you to abide by and be bound by these Terms and Conditions, as so amended.

Ordering Goods

Any order placed by you in the manner described by Do Good Labs is an offer by you to purchase a particular product or service for the price (including the delivery and other charges) specified by Do Good Labs at the time you place your order. Do Good Labs reserves the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this Website, or an error in your order. There may be reasons why Do Good Labs cannot fulfill your order. Therefore, your contract with Do Good Labs only comes into existence when Do Good Labs advises you that it has accepted your order and receipt of your payment has been confirmed.

Prices of products and services and delivery and other charges displayed by Do Good Labs on our website are current at the time of issue, but may change at any time and are subject to availability. The availability of products and services may change from time to time.

Do Good Labs will retain title to the products you order until you have made payment in full for those products.

You are responsible for any taxes, duties, or other liabilities imposed by any governmental agency, including without limitation, any customs duty, goods and services taxes, or any value-added tax imposed on any products or services acquired or ordered by you from Do Good Labs.

Pre-orders

Once your order has been shipped we will send you a tracking number. Exact delivery times will vary depending on your address and whether you selected standard or express postage. Please use your tracking number to see when your order will be arriving. By clicking on your tracking number it will take you to the Australia Post website. Promotions

For promotions where there is a free snack given “Freebie” with your purchase. The free snack will only be available while stocks last. Further, the order must occur within the promotion period to receive the free stock. For example, in the October 2019 promotion, Do Good Labs will be giving a free Fig Bar 30g with all box purchases while stocks last.

Shipping and Delivery

Orders will be shipped within 2-3 business days. For orders that may take longer than 3 business days to process, we will make contact with you to provide an updated shipping timeline. Please note that selecting Express Post does not mean that the orders are shipped sooner, only that the delivery time will be faster as per Australia Post. Once your order has been shipped, delivery time frames are dependent on Australia Post/StarTrack.

All times for delivery listed by Do Good Labs are indicative only. Do Good Labs will not be liable for any failure to observe these delivery times. You understand and agree that you shall not be entitled to withdraw or modify any commitment made for the purchase of products or services from this Website once that commitment has been made for any reason.

Once you have selected your address and finalized payment for your order, the commitment has been made and your package will be delivered to your nominated address. From this point of finalizing your payment, there is no option to change the delivery address.

Do Good Labs use Australia Post and/or StarTrack to deliver our products to your address. Delivery times will vary depending on your address and whether you select standard or express postage options. To get a more accurate delivery window, please use the tracking number emailed to you on the Australia Post website. Shortages

As soon as possible after delivery, you must check the quantity of the Do Good Labs products delivered against the quantity ordered and due to be delivered. Do Good Labs is not responsible for making good any shortage unless the Customer gives Do Good Labs notice of the shortage within 2 Business Days of delivery. If Do Good Labs does not receive a notice under this clause, the Do Good Labs products delivered will be considered to accord with the quantity ordered for the period specified in the Order and to be accepted by the Customer.

Damaged or Defective Products

Do Good Labs products will comply with the Do Good Labs Standards. As soon as possible after delivery, you must check whether the Do Good Labs products are damaged or defective or otherwise fail to meet the Do Good Labs Standards. The products will be considered to have been delivered in good condition and in compliance with the Do Good Labs Standards unless you notify Do Good Labs of the damage or defect within 2 Business Days of delivery.

If you notify Do Good Labs about defective or damaged products, you must:

• preserve the Do Good Labs products in the state in which they were delivered for 10 Business Days after it notifies Do Good Labs; and

• during that period, allow Do Good Labs to inspect the Do Good Labs products.

Do Good Labs will, at its option, provide a replacement, or give a credit, for Do Good Labs Products only where:

(1) you have notified Do Good Labs within 2 Business Days and have preserved the product in the state it was delivered, allowed Do Good Labs to inspect the product, and Do Good Labs is satisfied with the Customer's claim; and

(2) If Do Good Labs elects to have the products returned, the products are to be returned in the same condition as when first delivered to the Customer.

So far as permitted by law, Do Good Labs liability to you in respect of damaged or defective Do Good Labs products or failure of Do Good Labs products to meet the Do Good Labs Product Standards is limited to replacement or credit.

User And Other Information Provided By You

You agree to:

• provide certain current, complete, and accurate information about yourself as prompted to do so by Do Good Labs; and
  

• maintain and update this information as required to keep it current, complete, and accurate.
  

Any order placed by you with Do Good Labs must contain your name, email address, mailing address, credit card name and number, and the expiry date of your credit card so that Do Good Labs can process your order. Do Good Labs employ the services of Australia Post and/or StarTrack to deliver your packages. Only the information required to process your delivery will be shared.

All information provided by you when you sign up to become a Member/join the movement, or which you provide when placing an order is referred to in these Terms and Conditions as "User Information". You grant to Do Good Labs the right to disclose to third parties certain aspects of your User Information, provided that such disclosures do not include your name, mailing address, email address, account number, or phone number unless you expressly direct Do Good Labs to disclose such information.

When you provide any User Information you are representing and warranting that all of the information provided is true and correct and are agreeing to indemnify Do Good Labs for any losses, costs, expenses, or damages that Do Good Labs may suffer if any of this information is not correct.
